Original Post 2/5/2019 12:45 pm On Thursday the Knoxville City Council will have it’s first meeting in the Main assemnly Room at 5:30 pm and will take up Recode Knoxville.
I have not followed it as closely as I should have, however, a reader of #TheMegaBullhornofTruth has and has supplied me with these notes on Recode.
No citizen or property owner asked for Recode.
When the zoning consultant Camiros of Chicago was hired by the City of Knoxville there was no Recode, Camrios was hired only to tweak and upgrade the existing Knoxville City zoning code.
Mayor Rogero, Metropolitan Planning Commission, and City Council decided that Camiros should replace the entire existing zoning code with Recode. That has never been done in Tennessee.
This was all done with no input from citizens and property owners.
This was done without proper legal notice. No property owner was mailed a MPC rezoning notice. There were no little black MPC signs placed on properties.
The vote in MPC that approved Recode was illegal because it had only a ten day review period not the 30 day review period required by law.
Recode invalidates 50 years of case law that protects the property rights of the people of Knoxville.
Recode affects 74,000 properties in the City of Knoxville, Only .42% of the 180,000 people attended Recode workshops. Only 756 people went to Recode meetings.
There are only 603 comments on the Recode website.
Recode is based on false population growth numbers.
Only two articles in the Knoxville News Sentinel. 3 stories on WBIR and 3 stories on WATE. There has been little to no media coverage other than one radio station.
Current zoning requires adequate parking requirements for all apartments built in Knoxville.
Recode tremendously reduces those parking requirements which means new apartments will compete for parking with existing neighborhoods.
The grossly illegal parking requirements in Recode will cause expensive lawsuits with the American with Disabilities Act.
Parking for new building in Recode is removed from the front of the building and Parking must be located to the side or rear of the principal building.
MPC has broken several state and local laws trying to ram Recode through City Council before the next election with term limited City Council members and Mayor.
The first workshop in City Council will be February 7th in the Main Assembly Room of the City County Building on Main Street at 5:30 PM.
You need to attend in person and demand this be put on the ballot for all people to vote on.
Second workshop is February 21st in the Main Assembly Room of the City Council Building on Main Street at 5:30 PM.
Executive Director of MPC Gerald Green will be on 92.3 FM/760 AM Wednesday morning between 8:00 am and 10:00 am to answer questions about ReCode. Why did MPC not allow 30 days of review on the January 10th vote? That is illegal. Are they above the law?

You can expect a lawsuit over the failure to notify property owners. A lawsuit taxpayers will have to pay to defend.
Recode is a train wreck. I just watched 3 hours of nonsense in the City Council workshop on Recide. This needs to be send back to MPC. $489,000 has been spent on this incomplete flawed product. City Council can’t fix this. They don’t know how. This is MPC’s job. Taxpayers pay $3 million dollars a year for MPC. Make them do their job.
